Terms and Conditions

YOUR CONSENT

By placing an order and paying the deposit you agree to our Terms and Conditions. Work will only commence on your cake when the deposit has been paid. 

 

PRICES

All prices are non-negotiable and priced according to your design and size of cake.

Bakes in Bloom do not ‘price match’, as our prices are based upon our high standard of work and quality of ingredients used. 

Following your consultation/enquiry, your quote is valid for 30 days from the quote date. Paying your deposit (see below) secures this price and prevents any further price increases, except;

1. in exceptional circumstances beyond our control e.g.  fuel price increase, ingredient cost increase etc. and

2. Alterations made to original quote

 

ORDERS 

At least three working days’ notice is required for cupcake bouquets. It is advisable to book as soon as you know the date you require, particularly for weddings, weekends, summer dates and holidays (Easter, Christmas, etc). Short notice orders will always be considered however, there is no guarantee that there will be availability to fulfil your order.

Bakes in Bloom reserve the right to decline any order.

Bakes in Bloom cannot ‘copy’ a cupcake bouquet produced by another cake maker. If pictures are provided of another cake makers cupcake bouquet, Bakes in Bloom will produce an interpretation of that cupcake bouquet and it will not be an exact copy of the picture unless I am able to get written permission from the original designer.

Bakes in Bloom are happy to reproduce any cupcake bouquet previously made by themselves. Each order is made individually by hand, so although every effort is made to ensure consistency, small variations may occur from the design requested.

DEPOSITS AND REMAINING BALANCES

A non-refundable 50% deposit (total of order) is required to secure your order. Your date is not secured until you have paid the deposit. Your date will be held for 24 hours following enquiry, after this time has passed your date will be made available again and will be booked by the first customer to pay their deposit.

Customers can pay in full if more convenient. 

Remaining balance is to be paid, in cash, on or before collection/delivery. The cupcake bouquet will not be released until the remaining balance is received. 

Remaining balance is due two days prior to delivery when delivering to a third party. 

 

PAYMENTS

Payments can be made by cash, bank transfer, PayPal or by phone. Unfortunately, we do not accept cheque payments.

You should email us with confirmation of payment transfer in order to facilitate prompt acknowledgement of payment.

Remaining balances can be paid on or before collection. The cupcake bouquet will not be released until payment has been received. 

 

COLLECTION AND DELIVERY

All baked goods are for collection, unless delivery is requested at the time of order. 

Collection of orders is available from Bakes in Bloom via appointment during the following hours: Monday to Friday 11am – 6:30pm and Saturdays 11am to 12pm (closed on Sundays). Other times may be available onrequest but this cannot be guaranteed and arrangements need to made with at least 7 days’ notice. The customer is responsible for advising Bakes in Bloom if they are unable to meet the agreed time for collection. 

Cupcake bouquets collected after 11am are baked the same day.

All orders are made to order, arriving earlier than your expected collection time may result in your cupcake bouquet not being ready and the customer being asked to return at their scheduled appointment.

Bakes in Bloom offers a local delivery service. Delivery charge is on application. It is your duty to examine the cakes/cupcakes upon collection/delivery to ensure that the order is complete and that the goods have not been damaged in transit.

You are required to enter full and accurate details for delivery including the name, address and postcode of the recipient. We will not be responsible for any orders which are not delivered due to incorrect or incomplete information being supplied by you.
If there is no one there to receive the delivery at the agreed delivery date and time, then it will be deemed a ‘Failed Delivery’. The item/s will be returned to Bakes in Bloom and you will be responsible for collecting the items from my premises in Rugeley. I am unable to refund the order cost or delivery charges for failed deliveries.

Requests to change delivery/collection date and time should be given with no less than 7 days’ notice, please note it may not always be possible to accommodate these changes. 

Bakes in Bloom advise customers to travel with the cupcake bouquets on a flat surface, ideally the passenger foot well. The cupcake bouquet may need support either side to stop it tipping over. A transport box for Trio and Mini Cupcake Bouquets will be offered at time of collection.

Bakes in Bloom accept no liability for Cupcake bouquets that are damaged on or after collection or delivered to the agreed location.  

For Cupcake bouquets delivered to agreed locations Bakes in Bloom will provide a photograph as proof to say that the Cupcake Bouquet has arrived and that it is in perfect condition.

Cupcake Bouquets collected are checked by myself and checked by the person on collection. The customer consents that it has been collected in perfect condition by accepting the cupcake bouquet and removing it from the premises. Damages after this point are not Bakes in Blooms responsibility.

Cupcake Bouquets are fragile and require care and attention when handling, storing and displaying to prevent damage occurring.

 

CARE

 

As general guidance, Cupcakes should be eaten as soon as you can, preferably within 1-2 days to maximise freshness.

Cupcake Bouquets should be stored in a cool, dry place out of direct sunlight and must not refrigerated. Cupcake Bouquets should be kept flat at all times and away from strong odours. 

It is the customer’s responsibility to inform Bakes in Bloom if the cupcake bouquet is being consumed the day after collection. Bakes in Bloom can provide an extra piece of cellophane to put over the top of the bouquet for overnight storage. This will help prevent any dust, hair, etc. settling on the cupcakes.

Cupcake bouquets should be stored away from children and animals.

It is advisable not to consume cupcakes after three days of date made.

Buttercream colouring may stain and care should be taken whilst handling and consuming. 

 

DESIGN CONDITIONS 

Bakes in Bloom aim to produce cakes of highest quality that meet the desires of the clients as we understand them.

Each cupcake bouquet is handmade. Whilst every effort is made to ensure consistency in baking, a small amount of variation may occur both in the flavour, colour, size, design and texture of the recipe. 

 

ALTERATIONS AND CHANGES

It is the client’s responsibility to read and check the order confirmation document thoroughly; any amendments should be made in writing.

If requested, we will endeavour to adjust the design where feasible, but sometimes this is not possible due to the nature of the request or amount of notice given.

Minor changes will be accommodated; however major changes may result in a re-quote.

If the alteration affects the cost, or preparation work for the original design has already been started, then your balance will be adjusted accordingly. 

 

ALLERGIES AND SPECIAL DIETARY REQUIREMENTS

Unfortunately Bakes in Bloom do not offer 'free from' cupcakes as our kitchen is not a certified allergy free workspace. All recipes will contain dairy products, egg and gluten and the client assumes responsibility for advising guests of this fact. Products may contain traces of nuts.

Please be aware that although ingredients such as nuts and other allergens may not be in the products, they are still used in my kitchen, so I cannot guarantee that any of my cakes are allergen free. If you chose to place an order this will be at your own risk. I do not produce gluten free or dairy free products.
Allergens in bold: celery, cereals, crustaceans, eggs, fish, lupin, milk, molluscs mustard, peanuts, sesame, soybeans, sulphur dioxide and sulphites and tree nuts.
Professional Food Colours are used in the buttercream on Bakes in Bloom's cakes which vary from product to product depending on the colour choices made. The food colour manufacturers state that various allergens are used in the factories producing the products and therefore cannot guarantee they are allergen free.
Food Colourants contain various ingredients and additives which can include the following. If you need information about specific colours for your order, please contact Bakes in Bloom.

NON-EDIBLE ITEMS

 

Most special occasion cakes contain small proportions of inedible items; it is the client’s responsibility to ensure these are removed by your caterer/guests before consumption. Most of our custom cake toppers contain inedible items and are not suitable for human consumption.

Non-edible cake toppers can be purchased at an additional cost. Individual quotes are provided upon request. Bakes in Bloom require at least one week’s notice for bespoke cake toppers.

 

CANCELLATION  

Cupcake Bouquets and boxed cupcakes

If cancellation of the order is made 24 hours or more before the order is due for delivery/collection then your deposit is retained and any monies paid above the deposit will be returned.

If cancellation is made less than 24 hours of the delivery/collection time then all monies received will be retained as preparation of your cupcake bouquet may have started. 

Weddings and Cakes 

Remaining balances are due 2 weeks before collection date, preparation of order may not start until this has been paid. 

If cancellation is made within two weeks before the order is due to be collected all monies will be retained. If the remaining balance has not been paid then this is still due. 

If cancellation is made more than two weeks before collection date, deposit will be retained but any monies paid above the deposit will be returned.

In the unlikely event that I am forced to cancel an order through no fault of the customer all monies will be refunded.

All orders remain the property of Bakes in Bloom until paid for in full. 

Bakes in Bloom reserve the right to resell any order that is cancelled.

Refunds are only available in the unlikely event that there is an issue with your order that is purely my fault, in this case the cake MUST be returned for inspection. The cupcakes must be wrapped in cling film and returned to Bakes in Bloom within 14 hours of the event. Refunds may only be given if less than 25% of the cake has been consumed. No refund will be given if a cake has been stored incorrectly or kept beyond the use by date stated on the box. 

If the customer fails to collect an order at their designated collection time they will receive a message from Bakes in Bloom 20 minutes after the collection time. If the customer does not respond to this message to rearrange collection within 5 hours Bakes in Bloom will assume the customer no longer requires the bouquet and it may be resold. 

ONLINE DIGITAL COURSE

Note – All workshops are in English only.

Distance selling rules for digital services do not apply to Bakes in Bloom online tutorials. You are required to confirm you have read the terms and conditions prior to purchase as you have no right to a 14 day cancellation with these instant digital courses.
By ticking the box that you have read the terms and conditions prior to placing your order you are agreeing that you have read them and agree to the instant access. You will be able to access your online tutorial under the 'My Tutorials' section in your account. Please read the course content carefully before you purchase it as no refunds will be made.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses or for any reason does not, authorise payment to us, whether in advance of or subsequent to a payment, we will not be liable for any delay or non-delivery of the Products ordered.

PURCHASES OUTSIDE OF THE UK

Where online orders are placed by Non-UK customers the prices displayed on Bakes in Bloom's website will be deemed to represent the price in £ sterling. Sales outside the UK will be zero rated for VAT purposes in accordance with current HMRC regulations.
Products to countries outside the UK may be subject to import duty, taxes and any other State, Federal or National charges which may be imposed in the destination country all of which shall be the sole responsibility of the purchaser to pay and indemnify Bakes in Bloom from all such charges and any consequential costs and responsibility. We would suggest that you contact the relevant authorities in the destination country for locally specific information. Bakes in Bloom shall not be responsible for any charges that may be levied due to circumstances beyond our control such as customs exam fees or any other charges outside the normal remit of Bakes in Bloom. These charges apply to all Bakes in Bloom products unless specifically excepted, in the Company’s website and/or any other sales literature and offer notifications.
Online courses purchased are only available for viewing via logging on to Bakes in Bloom's website. They are not available for download.  You will have to crate an account on Bakes in blooms website in order to purchase the tutorials. It is vital that you correctly enter your email address. Once purchased you can view the course as many times as you choose for a 2 year period, after this time the course link may expire.
If a course is removed from sale we will you will retain access to it for a minimum period of 2 years after it is removed.
Bakes in Blooms tutorials are for individual use only. They are not to be used for teaching purposes or group viewing without the express permission in writing from Bakes in Bloom. They are not to be copied or shared amongst groups of people.

Note – All courses are in English only without subtitles.

 

PHOTOGRAPHS 

Bakes in Bloom reserve the right to take photographs of all baked goods for advertising purposes.

It is the customer’s responsibly to inform Bakes in Bloom if they’d like the photographs and a special message to be put on social media on a specific date.

 

COMPLAINTS 

·      Complaints are very rare and are taken very seriously by Bakes in Bloom. Some complaints may require further investigation and cupcakes must be returned within 14 hours for inspection, therefore immediate refund may not always be possible. 

·      The maximum refund Bakes in Bloom offer is the value of the cakes and any delivery charges.

·      Corrections to cupcakes, including inscription mistakes, can be corrected on the same day in most cases
